Public Notice of Non-Compliance (TCR 2010-#30)

AKWESASNE, NY—The Saint Regis Mohawk Tribe’s (SRMT) Compliance Department Inspectors initiated a controlled buy of alcoholic beverages from tribally licensed businesses during the week of April 1-10, 2015. The controlled buy program; which is a mechanism used to ensure that alcoholic beverages are only sold to individuals who have reached the legal age of twenty one (21) and over, is required by Appendix D of the Off Premise Alcohol Beverage Control Act (1991).

The following businesses were issued “Notice of Violations” as indicated below.

AKGas and Convenience, 1569 State Route 37 Akwesasne NY

First Offense:Sale of Alcoholic beverages to persons under 21 years of age

Fine imposed: Eight hundred ($800.00) dollars and six (6) months’ probation.

Hill Top / C+ R smokes, 263 State Route 37 Akwesasne NY

First Offense:Sale of Alcoholic beverages to persons under 21 years of age

Fine imposed: Eight hundred ($800.00) dollars and six (6) months’ probation.

Akwesasne Mini Mart, 155 State Route 37, Akwesasne, NY

First Offense:Sale of Alcoholic beverages to persons under 21 years of age

Fine imposed: Eight hundred ($800.00) dollars and six (6) months’ probation.

CT’s Country Market, 113 St. Regis Road, Akwesasne, NY

First Offense:Sale of Alcoholic beverages to persons under 21 years of age

Fine imposed: Eight hundred ($800.00) dollars and six (6) months’ probation.

Twinleaf Gas & Tobacco, 18 State Route 37, Akwesasne, NY

First Offense:Sale of Alcoholic beverages to persons under 21 years of age

Fine imposed: Eight hundred ($800.00) dollars and six (6) months’ probation.

In 2012, the Compliance Department began offering Training for Intervention Procedures (TIPS) for tribally-licensed businesses that serve and/or sell alcohol. The purpose of training sessions is to help create a business environment that promotes safety and responsibility, as well as compliance with applicable tribal laws. All businesses that have been cited and issued a Notice of Violation are required to have staff trained by the Tribe’s Compliance Department on TIPS to retain their alcohol license.

The goal of TIPS trainers is to build skills, instill confidence, and empower participants to step into situations and ensure that alcohol is being sold responsibly and legally. To learn more about TIPS, please visit www.gettips.com or contact the Compliance Department Office at (518) 358-2272.
